Gestüt Famos

All mare owners who have booked the stallions at the Famos EU Station accept the following Terms & Conditions for all present and future business transactions.

  1. 1. In General
    1. 1.1. The breeding season begins January 15th and ends August 15th of each year.
    2. 1.2. Fresh semen is available from the stallions Callaho's Benicio, Coal Diamond, Commando, Commissario, Contendro I, Dancing World, Darshan, Devine, Don Marco, Kaiser Karl, No Surrender, Rapace and Rock of Gobraltar.
    3. 1.3. For customers from abroad, frozen semen is available from the following stallions: Ars Vivendi, Bamako de Muze, Caddington, Callaho's Benicio, Don Marco, Elvis ter Putte, Hunter's Scendix, Hunter's Scendro, Lord Lennox, Providence, Showdown, Van Helsing.
    4. 1.4. Customers from abroad must provide the following additional information:
      VAT ID No., if the customer has one, and the business operation number of the veterinarian.
    5. 1.5. The result of a cervical culture must be presented for insemination with frozen semen!
  2. 2. Shipment of semen
    1. 2.1. The shipment of semen must be ordered by phone of fax by 10:00 a.m. at the latest, providing the following information:
      The name of the desired stallion, name and complete address of the mare owner, information on the mare such as name, life number, copy of the pedigree, date of birth as well as member number of the breeding society to be informed of the insemination.
    2. 2.2. The shipment of semen on Sundays and holidays is not possible; pick-up is possible after an appointment has been made by phone.
    3. 2.3. The shipment of semen is at the expense of the breeder. A charge of 25.00 € weekdays and 70.00 € Saturdays will be made by the stallion keeper. A quotation for the cost of shipping abroad will be given upon inquiry. The ability to ship semen abroad on Saturdays is limited. A certificate from an official government veterinarian is required for the shipment of semen abroad for which a fee of 40.00 € will be due.
    4. 2.4. Evidence of dispatch forms must be completely filled out and returned immediately after insemination.
    5. 2.5. If a stallion should not be available for a short term during the course of the breeding season for special reasons (away at shows, illness, etc.) frozen semen can be used, if available, or, if desired, another stallion at the station can be used. If we cannot guarantee that the stallion will be available the following year, we are entitled to use a replacement stallion. Differences in the stud fee will not be reimbursed nor is there a right to reimbursement of the stud fee. If a stallion has a heavy breeding load, only two insemination doses per estrus will be provided.
    6. 2.6. For mares that were inseminated for the first time after July 1st of the respective year and do not come in foal, the stud fee in the respective price category will be credited to the following year. In case of mares that do not come in foal or have absorbed, only half the stud fee will be invoiced the following breeding season if a veterinary certificate confirming that the mare is not in foal is submitted by December 31, 2013.
  3. 3. Guest stables
    1. 3.1. Stables for guest mares are available at the Gestüt.
    2. 3.2. The charge for boarding mares with foals is € 12.00 per day and € 10.00 for mares without a foal.
    3. 3.3. To make sure that operations run smoothly, we kindly ask you to pick up your mares within two days after notification by phone.
    4. 3.4. If the mare is not picked up within two days after notification, the charge for boarding will be increased as of the third day to € 15.00 per day.
    5. 3.5. Charges that have been incurred are to be paid when the mare is picked up.
    6. 3.6. A veterinarian may be called in at the expense of the owner of the horse if deemed necessary by the stallion keeper. The cost of treatment will be billed directly to the owner of the horse by the treating veterinarian. Whenever possible, the owner will be informed beforehand.
    7. 3.7. Veterinary services for mares are provided by: Tierärztliche Klinik Siedenburg, Dr. Christian Schröer, Borsteler Str. 50, 27254 Siedenburg
  4. 4. Liability
    1. 4.1. The stallion owner is only liable for damage caused by willful or gross negligence on his part or the part of an assistant. This liability limit includes all damage that could arise while the mare is boarded and, in particular, when the mare is brought to the stallion.
    2. 4.2. The stallion keeper is not liable for any damage caused by third parties.
    3. 4.3. The owner of the mare is required to hold liability insurance to cover any risks governed by German law on owner's liability for animals (§ 833, 834 BGB). Proof of liability insurance held by the mare owner is to be presented upon request.
  5. 5. Settlement of the stud fee
    1. 5.1. The stud fee applies to the mare to be inseminated and is due before the mare is inseminated the first time.
    2. 5.2. If the mare is not in foal or has reabsorbed/aborted, the breeder is obligated to present confirmation in the form of a veterinary certificate by December 31, 2013. If a veterinary certificate has not been received by this date, the rebate stated under 5.3 will not apply.
    3. 5.3. If the same mare under 5.2 is inseminated by the same stallion in 2014, a rebate in the amount of 50 % of the stud fee paid in 2013 will be given. Prerequisite: the certificate of confirmation stated under 5.2 must be presented by the date specified.
    4. 5.4. For mares that did not come in foal or have reabsorbed/aborted in 2012 for which the full stud fee was paid in 2012 and a veterinary certificate was presented on time (deadline December 31, 2012), only half the stud fee stated in the 2013 stallion catalogue will be charged if the mare is inseminated by the same stallion again. This stud fee is due before the first insemination.
    5. 5.5. No discounts will be given by the Gestüt. Wrongfully deducted discounts will be immediately invoiced.
    6. 5.6. If bills are not paid within the stipulated period for payment, any rebates granted (e.g. quantity rebates, etc.) no longer apply and the entire stud fees will be due.
    7. 5.7. All costs arising from arrears are to be paid by the breeder.
  6. 6. Embryo Transfer
    1. 6.1. The breeder is obligated to inform the Gestüt before the first insemination that an embryo transfer will be made.
    2. 6.2. Embryo transfers are to be documented by the executing veterinarian, using the form provided and returned to the Gestüt immediately afterward.
  7. 7. Settlement of Frozen Semen
    1. 7.1. The resale of frozen semen is prohibited. If frozen semen is to be resold, prior written consent from the Gestüt is required.
    2. 7.2. Transport containers for frozen semen are to be supplied by the customer.
    3. 7.3. Settlement of frozen semen, shipping costs as well as a flat charge of 50.00 € for liquid nitrogen must be made before delivery.
      1. 7.3a. For shipment abroad: same as 8.3 plus a charge for the German government's Veterinary Control Board certificate in the amount of 75.00 € per stallion and shipment.
    4. 7.4. In exceptional cases, a shipment container may be provided by the Gestüt. The charges for this are as follows:
      • Guarantee deposit in the amount of 1,500 € (the deposit is due before delivery and will be refunded when the container has been returned)
      • Lending fee: 50.00 € for each beginning week as of the date of shipment
      • Flat charge for liquid nitrogen in the amount of 50.00 €
  8. 8 Place of performance and venue
    1. 8.1. The place of performance and venue is the domicile of the stallion owner, 28857 Syke, Germany.
    2. 8.2. If the breeder is a registered trader, the exclusive venue for all present and future claims from business transactions is the domicile of the stallion owner, 28857 Syke, Germany.
    3. 8.3. Stud fees include value added tax (VAT).
    4. 8.4. The stallions may be viewed by appointment only.

We expressly point out that the presently valid General Terms & Conditions of Gestüt Famos GmbH are a part of the entire business transaction. The General Terms & Conditions are posted in the office of Gestüt Famos GmbH and on the Internet under www.gestuet-famos.de and will be made available upon request.
